The Board of Zoning Adjustment (BZA) exists to hear all appeals or consider any matters referred to it under the Zoning Regulations or pursuant to any other ordinance. The following matters may be appealed to the BZA:
- Appeal requesting variance from Zoning Regulations.
- Appeal requesting exception from Zoning Regulations.
- Appeal a decision of an administrative official administering the provisions of the Unified Development Code (UDC).
The BZA is composed of five (5) members who are residents of the City and are appointed to five-year terms. The BZA meets as required or upon the call of the Chairman. Appeals to the Board of Zoning Appeals must be filed in writing, setting forth the grounds for the appeal and identifying the person(s) filing the appeal. The established fee for filing an appeal with the BZA is $250 plus associated publication costs.
Appeals must be filed with the City Clerk within ten (10) days of the denial of the permit requested. Anyone wishing to appeal a decision of the BZA may bring an action in the Circuit Court of the county for which the decision was rendered.
